Larry and Dannielynn in OK!

The first photos have surfaced showing proud papa Larry Birkhead with his and Anna Nicole Smith's daughter, Dannielynn.

OK! has the exclusive shots and an interview with the L.A. based photographer, who last week was determined to be the biological father of the 7-month-old.

In the mag, Birkhead reveals that just three days before Dannielynn's birth, Anna sent him an e-mail saying: "Don't fall in love again, I'd be a bit jealous."

Interestingly, Birkhead states that contrary to what people may think, Anna's alleged lover, Howard K. Stern, has been "a great help" with baby D, but adds:

"Howard did things for Anna that no one wanted to. I actually feel sorry for Howard."

As far as Anna's mother is concerned, Larry says Virgie's not his enemy.

"If she wants to be a grandmother, she can be a grandmother, my mom wants to be a grandmother too, but I'm not going to sign a paper saying so, it's just not right." Read between the lines, please!

A custody hearing for Dannielynn is scheduled for Friday in the Bahamas. As for the photos, all proceeds from their sale will be put into a trust for Dannielynn.

Birkhead's the father

Larry Birkhead is the father. The DNA results were unveiled a couple of minutes ago and it's a DNA match for Birkhead and Dannielynn.

An emotional Larry Birkhead thanked the crowd after Dr. Michael Baird released the DNA results to the judge. The probability of paternity is 99.9999%.

Howard K. Stern said:

"I am obviously very disappointed ... I am not going to fight Larry Birkhead for custody. I will do everything I can to make sure he gets sole custody."

Stern said he'd like the transition to be "gradual," so the baby can adjust. He says he will stay in the Bahamas.

In a remarkable twist, the onetime arch rivals Howard K. Stern and Larry Birkhead hugged each other outside the courtroom.

Before hugging, Stern said Birkhead was welcome to come to the house and spend as much time with baby Dannielynn as he wanted.

Paternity test not going to be made public

A Bahamian court is expected to rule today in the paternity case of Anna Nicole Smith's infant daughter, but it seems that the results will not be made public after all.

Under Bahamian legal rules, the results cannot be made public by either of the parties involved in the paternity and custody battle unless the judge in the case lifted the gag order.

The people fighting over custody of the child -- Larry Birkhead, Howard K. Stern and Smith's mother, Virgie Arthur -- have all been ordered not to talk about the results after the ruling.

The child, Dannielynn Hope Marshall, could inherit millions from the estate of Anna Nicole Smith's late husband, J. Howard Marshall.

Anna Nicole died of accidental drug overdose

Nearly two months after Anna Nicole Smith tragic death, the official toxicology and autopsy reports were released this morning.

According to the reports, the Playboy Playmate died of an accidental overdose of a sleeping medication and at least eight other prescription drugs, and she had recently had a bacterial infection from injecting drugs into her buttocks, authorities said Monday.

Broward County Medical Examiner Joshua Perper said Smith died of “combined drug intoxication” with the sleeping medication chloral hydrate as the major factor.

She had been taking a lengthy list of medications, including methadone for pain and valium, but those drugs were at therapeutic levels, he said. A bacterial infection from injecting medication in her buttocks and the flu contributed to her death, according to the report.

Chloral hydrate is a sedative used to treat insomnia and alcohol withdrawal, relieve anxiety and ease post-surgery pain.

The drug is rarely prescribed and is known to be fatal if combined with certain other drugs — including the sedative Lorazepam, which the autopsy showed she was taking, said Dr. Chip Walls, a forensic toxicologist for the Miller School of Medicine at the University of Miami.

“It’s very toxic if you mix it with any other central nervous system depressant drugs,” Walls said. “You could get profound sedation leading up to coma and respiratory arrest.”

Perper said Smith also had been on several antidepressant and antianxiety drugs and had recently taken longevity medications, vitamin B12 and growth hormone. An assistant medical examiner’s report described seeing a table in Smith’s hotel room containing cold medicine, sodas cans, SlimFast, nicotine gum and an open box of Tamiflu tablets.

“We found nothing to indicate any foul play,” said Chief Charlie Tiger of the Seminole police department.

Howard K. Stern will fight on

Howard K. Stern has said he'll fight to keep Anna Nicole's daughter - even if DNA tests show she's not his.

Mr Stern's lawyer today said he was complying with court-ordered DNA testing, but the result may not stop a drawn out legal fight.

The paternity of six-month-old Dannielynn, who stands to inherit a fortune, has been fought over since her Playmate mother's death in Florida last month.

Smith's ex-boyfriend Larry Birkhead has taken the matter to court, but is one of several men claiming to be the girl's father.

Today, Mr Stern's lawyer James Neavitt told the Associated Press: "Howard is the legal father.

"If Mr Birkhead's DNA matches, then he can come and say he's the biological father, and then you'll have that court battle."

However he did indicate the two men might try to negotiate a settlement if Mr Birkhead was in fact Dannielynn's dad.

"Dannielynn's interests are the most important, and Howard's been protecting her from the start," he said.

Mr Stern is listed as Dannielynn's father on her Bahamian birth certificate.

The little girl is heir apparent to Smith's estate, which could be worth hundreds of millions of dollars if it wins a fight to inherit from Smith's late oil tycoon husband, J. Howard Marshall.

Howard K. Stern admits he's not the father

Howard K. Stern has reportedly admitted he's not the father of Anna Nicole Smith's daughter Dannielynn and is now willing to sign over the paternity rights to the man who believes he is the baby's real dad, Larry Birkhead — for the right price.

Since Anna Nicole's shock death last month at the age of 39, the legal wrangling over paternity has increased, with an adamant Larry continuing the fight he started when Dannielynn was born last September.

However, while Anna Nicole fended off Larry's court orders for a DNA test, now she's passed away it's rumoured Howard is willing to hand Dannielynn over to Larry in exchange for a portion of her estate.

While Howard is listed as the girl's father on the birth certificate, insiders say that, during a recent meeting with Larry, he confessed he's not the dad. While Anna Nicole fought to keep Larry away from Dannielynn while she was alive, Howard let his former lover's rival meet the baby recently.

In exchange for giving Dannielynn to Larry, insiders say Howard wants ongoing control of Anna Nicole's estate. Once all the issues surrounding the estate have been settled, he also wants to become Dannielynn's trustee.

It's unknown how much money Anna Nicole had when she died, but the star had recently won the right to contest more than $600 million from the estate of her late husband J. Howard Marshall II, an oil billionaire who died in 1995 without writing Anna Nicole into his will.

Howard, who's admitted he was financially dependent on Anna Nicole, is also rumoured to be claiming the Bahamas house and the boat the star bought shortly before her death.

While Larry hasn't commented publicly on the secret deal between the two men, he has revealed how happy it made him to hold five-month-old Dannielynn for the first time. He says seeing her confirmed to him what he knew in his heart all along — that he is her father. "She's mine," he says. "That's my baby. She looks like me — she is mine."

ET has the exclusive final footage of Anna Nicole Smith with her baby Dannielynn Hope caught on tape.

In the home movies, filmed just days before Anna Nicole's untimely death, the
39-year-old mother lovingly dresses her daughter in a pink outfit.

"She's got my personality. She's so tall. She's got really long fingers like mine and she's real dainty. ... She rolls over; she's very strong. She holds her head up. She can say a couple words -- she says, 'Ma-ma.' She's tryin' to grow up faster than she is, and she gets aggravated 'cause she can't."

Sadly, now that Anna Nicole is gone, a major baby battle is brewing. Little Dannielynn's innocent existence has become a lightning rod of controversy, with several parties attempting to lay claim to her -- and the potential windfall she could stand to inherit. Paternity and the child custody decision could determine what happens to that inheritance.

Questionable claims and theories abound -- like how Anna Nicole's half-sister, Donna Hogan, alleges in an upcoming tell-all that her sister used the frozen sperm of her ex-husband, billionaire 90-year-old J. Howard Marshall to become pregnant with Dannielynn; and Zsa Zsa Gabor's husband, Prince Federic Von Anhalt, claims that he is the father of the baby after an alleged decade-long affair with the former Trimspa spokesperson.

But before those posthumous claims came out of the woodwork, Anna Nicole's alleged former boyfriend, photographer Larry Birkhead, declared that he is the father of the child and has waged a legal battle to determine paternity of the baby. Last Friday, his lawyer submitted a request for an emergency DNA test on Anna Nicole's body as part of his ongoing paternity suit. But an L.A. judge refused the request, and Anna Nicole's body will be preserved until another hearing on February 20.

Birkhead's attorney, Debra Opri said that:

"Larry wants his baby. Larry will do everything to make sure that Howard K. Stern does not have that child."

Anna Nicole's estranged mother, Virgie Arthur, took action over the weekend and flew to the Bahamas to look after what she believes to be are the best interests of Dannielynn, who is currently said to be under the care of Stern's mother and sister. Virgie was spotted visiting several locations in Nassau, including the Southern Police Station on Quakoo and Market Streets, and a social services address on Thompson Blvd., reportedly trying to get the local police and child protective services to intervene on her behalf.

Under Bahamian law, Stern -- whose name is on the baby's birth certificate -- now becomes the baby's sole legal guardian. ET was with Howard as he reluctantly left the body of Anna Nicole to be with the 5-month-old child, whom he says is the light helping him go on.

"I wouldn't be here now, but I had to get back to Dannielynn. I held her in my arms and couldn't believe her mom is gone. I know Anna loved her more than anything in the world."

In October, Anna Nicole herself said that she detested Virgie, saying:

"She's not my mother, she's my birth mother."

Stern has vowed to maintain Anna Nicole's wishes, saying Virgie is not welcome:

"As long as I have a breath in my body, that woman will not see Dannielynn. She has no right. She can't take Anna's baby."

Anna Nicole Smith dies

Anna Nicole Smith, the voluptuous former Playboy centerfold who married an octogenarian billionaire and waged a legal battle for his fortune all the way to the Supreme Court, died Thursday after collapsing at a hotel. She was 39.

Anna Nicole was been rushed to Memorial Regional Hospital in Hollywood, Florida, shortly after 2 p.m. EST after collapsing at the Hard Rock Hotel & Casino in Hollywood.

Edwina Johnson, chief investigator of the Broward County Medical Examiner's Office, said the cause of death was under investigation and an autopsy would be done on Friday.

A private nurse called 911 after finding Smith unresponsive in her sixth-floor room, said Seminole Police Chief Charlie Tiger. He said Smith's bodyguard administered cardiopulmonary resuscitation about an hour before she was declared dead. She is believed to have expired on the scene.

Anna Nicole was reportedly treated with Narcan on the scene. Narcan is a substance generally adminstered to remove narcotics from a person's system.

Anna Nicole has made headlines in recent months in her ongoing fight over money following the death of her billionaire husband. Smith has also battled weight, alcohol, and depression troubles and the recent death of her 20-year-old son.
